Regarding the confusing scene:
The scene where Benicio is released because there isn't enough evidence pertains to him saying he shot Sean Penn.
It is not in regards to him being released because of hitting the father and two children.
In that part, he was let go because the mother/wife/widow did not want to press charges.Now you know. :)
Great movie, a little confusing at first but very good.
