  Yeah, a copyright or trademark is only going to be as good as your intent and ability to enforce it. Once I was presented design assets from an old client, and the logo looked an awful lot like someone elses', I asked if they saw the resemblance and if they had looked into whether or not it was trademarked - to which they responded "so what if it is?".
