well, if you want to get into software plagerism, the majority of apps that exist today are built on libraries that have been used for years by every other developer out there.
libraries are shared regularly, in order to provide quicker development times.
it's like saying that your usage of tables for layout is biting off of someone else. At the end of the day it's functionality, gui and service, but hardly the underlying idea behind the app.
If that were the case, Sharman Networks have been selling downlaodable music from a desktop app for a couple years now, i.e. apple takes a bite as well.
