It is an obvious imitation, but come on... Shut them down?
Did you take a minute to see what this company does?
They teach little kids to dance. Is that seriously any type of industry competition you have to worry about?
It seems obvious that they hired someone with less than intact scruples. It is hardly the fault of a bunch of goofy dance instructors.

I would approach them on a far more diplomatic level, explain to them that it has been brought to your attention that whoever they have had design their site has given then a plagerized product. Explain that you would rather not have to pursue a law suit, or any other form of legal injunction. And offer them a solution.

Here is one: "listen guys take down the site which is an obvious rip of mine, fire your designer, and let me design you a site that is original."
They obviously approve of your design sensibilities. This could be a win win situation. The designer that ripped you gets canned, and you make a friend, and get to design a site for a good cause.
