1) You personally shouldn't be held liable. At the very least document what the problem is right now and date it so you have record of it if there is ever a problem.
They're the ones in charge, I would hope they would be held liable.
2) Do you know that you would lose a portfolio piece? Because you didn't mention if you're under a contract that states you can't put any of the work you do for them in your personal portfolio.
