You could gain much from using a grid, when designing your layout. Also you need to consider that people use different screen resolutions, so that fluid top bar gets really wide in my settings. It moves the headline completely out of focus. So either make all the content fluid or make the top bar fixed for a certain res (ie. 960px).
Your index page is a splash screen with nothing interesting on it. You should in stead push some of your important information up front, to that space. It's not worth it playing with users' patience.
Consider a different color palette. What do you want to tell people by using brown, white and black?
