its not too late to get something in writing... write up a contract, get him to sign it and date it whatever date you want.... he'll do it if he plans to pay you.
and yeah... get control of the site somehow... like cripple their ability to update content or something... its better than taking it down because he'll subtly realize you have his nuts in your fist until he signs.
its a less confrontational route if thats what you're interested in
