Yeah, you're probably not going to get out of these unless you really bully them. My understanding (and experience) with overdrafting is that it is solely your responsibility to prevent overdrafting on your account.
You may recieve notices (usually way after the fact) from your bank too.
You can get overdraft protection from most banks for your account but you usually have to have a credit line through them with a decent amount of credit available for the overdraft.
There is always a catch-22 to overdrafting too. Read the fine print.
