Easy tiger... I'm on your side - I agree, he/she should pay the rights if it's a "rights reserved" image. But maybe that image was everything he was looking for. It's obviously based on the Getty image but has been modified and simplified enough to be an original piece of artwork.
Just because it's "just another vector illustration" is no argument for it being a crap shirt. Doesn't matter if he is a good designer or if it's a crap shirt - people will still buy it. Good on him for producing something marketable, albeit with a ripped off Getty image.
