Looking at the sites in more detail I can't say they look alike in anyway. The menu "looks" similar but when you rollover it expands and your doesn't.
Their site is full screen and your site isn't. It's not a copy at all. If they had taken your code and design and made a site that was identical then yes you had a legal case there.
