I got into a very similar circumstance where i made illustrations based off the photos i found on getty for the body poses. I didnt have any detail in the faces and it was vector shapes (almost ipod commercial-esque). Different enough or modified enough i thought. I was wrong. Getty found em and we had to pay 25k US. some of these other posts are right. Photographers took these photos and want to be paid for it.
That said just put a tagline that the image was a comp or something. Or swap out the layer of the photo used with a big fat middle finger. royalty free of course.
