the issue is with the health of the staff as opposed to the customers. and it is dependant on other health protection legislation...
i don't agree with the ban but I've lived through the transition in two countries, and people have said exactly the same stuff you're saying before in both countries :) the arguments are old.
As far as I could tell in parts of spain the ban was on the discretion of the owner of the premises and the owner simply asks the staff what they want (correct me if i'm wrong) - I was recently in barcelona smoking away in lots of pubs..
