...I don't know how things work where you are - but I know from past experience that these things get classed as an "act of god" - we had a massive wasp nest in the chimney in a house I lived in and they were coming through the fireplaces in all the rooms that were attached to the chimney.
After a visit from the relevant people (wasp killers) we removed the nest and wrecked carpets throughout the house in the process - when it came time for the insurance people to have a look at the damage and pay up they hit us with the act of god card!!! Didn't get a penny from them and had to replace the carpets ourselves.I hope you get a better result from this than I did from my experience - but I'd watch out for that "act of god" clause.
Also - should't you have signed the contract prior to moving in?
