the problem with that argument is that the court system is not a forum for vengence. the justice system (never was called the vengence system) was designed for the benefit of society, not the victims.
the best decisions are made by an unimpassioned observer. if you're a crime victim thats sad and you have a right to voice your opinion during sentencing, but you don't have the right to have the state sanction your revenge.
