I felt sorry for Rebecca Gayheart when she killed a little boy, but I actually think those circumstances were different. She wasn't drinking, it wasn't her just going around "having a good time", and the little boy ran across the road. So the way she got off (I think she paid some money and did community service) was fair enough.
As for this guy, if he was drinking then he deserves something. I know he'll feel horrible about it for the rest of his life, but obviously that's not as guaranteed as actually putting him in prison, for most people.
