I dont know if this is strictly true or not, but I have been lead to beleive that if the work is the public domain, then for self promotional purposes (application of your trade) you can use the work with appropriate accrediation.
Lets face it, its not the crime of the century to show a folio, regardless of what your boss says. And from that viewpoint, his 'legal' angles would seem pretty limited. Its probably all bark and no teeth.
