ah, shitty. You're screwed.
I remember in highschool my buddies band wrote a tune called "Sink".
Then, a month or so later Nirvana Nevermind came out and one of the tunes (can't remember which one) had a riff that was EXACTLY the same as the chorus riff for "Sink". Note for FN note.
They were fucked. They had to ditch the song because no one would ever believe that it wasn't a rip off.
It was a good tune too.
