Hopefully this is a lesson to always have a contract. I can see how you might want to protect your code but consider your client. How will the update the site when needed?
I had a change of heart about this topic after working with someone on a pro bono AIGA project and the guy refused to turn over source files yet went MIA when it came to updating content.
If you won't turn over source files, have a strategy for your client to be able to easily update.
