this may be a pain....but you can turn all your paths into vector shape masks with color fills. so now all your layers will have vector shape masks defining the shape/path. save as a photoshop eps don't flatten because your letting photoshop figure this all out... make sure your eps settings are as follows:
Preview: Macintosh(8bits/pixel)
Encoding: Binary
and the most important!!
Include Vector Data button is toggled on!
Then drag that eps onto Illustrator CS or CS2 and let illustrator parse that eps... it may take awhile but all your paths will come in as clipping paths in their own layers...like i said bit of a pain...
