yes, you can copyright code. although, it is much, much 'easier' to do this w/ both desktop and/or server-side software than it is for dynamic scripting, or other 'web' code.
i say easier in that there are more cases where this has been upheld and models contracts can look @ for guidance and support.
depending on the situation though, i say donate the code so that others can either better it's efficiency or behaviors, or so others can learn. but then i am a strong supporter of several open source communities.
