  Have it in the contract. Some people have it that anytime after 8 hours gets billed as overtime (even if you haven't worked 40 hours in the week). Other people have it that anytime over 40 hours in one business week is overtime. Weekends usually qualify for time and a half and Holidays usually qualify as double time.
