if someone had approached you about some work in umm lets say jan/feb 05, you supply a quote and they give you half the money upfront which works out at about a grand. Then they fumble around with this and that and you do a few bits and bobs for them, supply their hosting and stuff, but the actual work never arrives.
Then yesterday you get the email., they are finally going to get you the work, but it's a lot less work, and they 'kindly' offer to hold in reserve the surplus hours for future work, really kind.
So what do I do, I'm noit interested in teh work especially, I had given them a very cheap quote at the time which is obviously out of date. No contracts were ever made as I had done work for them before.
Can I just fuck them off, keep their money as a cancellation fee and claim a no refunds clause considering it has been over 18 months? I know that's a cunts trick really, what a nightmare.

tell em you expired 2 months ago

do they know where you live? move house and do a runner with the cash I say!

Most quotes I do and receive last for about 3 months.
I think if anything, you're well within your rights to re-quote.
If you don't fancy doing the job, then tally how much time you've spent on the job and refund them the difference.
On a side not,I can't understand the business practices of people like this, and anyone who dicks around like this is never going to be good to work for.

I'd just tell them you're keeping the money and won't be working any further hours on any projects for them if this is how they operate.

yeah clearly the quote is out of date, and it was one of those "oh and were going to have this and that coming up' scenarios which I never believe and never happened.
Damn for spending their money, I can't really be giving it back now :/

just tell them I'm keeping their money, hmm I like that idea..

honest
(Aug 24 06, 03:02)that won't save you from legal action, they can trace you by your chamber of commerce number etc. etc.
did you mention an expiration date at the time?
also, you should point them out that this amount was intended for the current project and can not be moved around. i would not allow that either..

poor you i bet there's absolutely NO motivation to do the work as they paid so long ago!
be very clear to them that the quote is out of date, tell them exactly how many days' work they can have (and have already had) and specify that it has to be a certain amount of work at a time, you don't want their shit dribbling on forever now do you? well don't say that. e.g. if it's 3 days work, they can have no less than 1 day at a time. explain you have other clients and chopping and changing disprupts your workflow.

say your rates have gone up and currently the money they have paid amounts to the production of one animated gif.

ya vespa, I shall have to calculate it all and be very strict with them, my heart was never in this job in the first place, this just makes it soul destroying let alone uninspiring.

tell them you'd love to do the work but right now is horrible timing because of other current contracts you've signed and you'll be available in april 07 or so.
- _salisae_0
yeah that won't work either. i guess you'll have to do the stinking job.
