I guess it comes down to who is claiming ownership of the work.
You could say you were asked to work along the ideas put forward by the client, so, really these weren't your own ideas, if you were paid, it was as a basic "labour' charge. Let the client take ownership of the work, let them argue it out in court.

We talked to the client and let them know that they didn't have permission to use anything that was presented to them. Despite the fact this was told to them at our presentation. Thats it.

that's what'll happen, the agency have already said "I thought as much" when on the phone to us, we're all in it together in this respect I suppose - I wouldn't blame them for being cuntish about it, but they aren't so more power to them.

fuck don't worry about it. You were pretty innocent it seems, do you have any reference to the client saying use this as reference? If not... make it up.
Fuck em. You did what you were told to do, where do you stand in chain of command (creative, senior, art worker etc?) Is there not someone senior to you who should of chased it all up?

I think it's a common thing tho. For some reason (bad) clients see the production/execution as the actual work they are paying for, and the idea/concept as something that comes for free from various companies during pitching (wow free consulting!). Likewise when you get a client who chooses you as the agency but is attached to a somewhat preordained/halfassed concept you always have to wonder if it was their idea, or another agencys answer to a request on the creative brief.
