Hi
Does anyone know where I can find information on NYC freelance laws? I have someone who works with me as a freelancer and has consistently full time for 7 months. I think she should be hired and think my company may try to get around it because of economy. If I have concrete info. about laws I can probably get her hired, if the law states you must hire someone if they work for you consistently for 1 year, etc
thanks in advance for any info.

I don't think there is any type of law like that. I could be way off though. I seems like that would be an some type of clause with-in her contract with the company. But once again i have no clue.

Yes, i think may be right rson
thanks to automaticiam
I found this article on
workingtoday.com
pretty interesting anywayhttp://www.workingtoday.com/reso…
she is happy, and I'm sure she does not want to bring our company to court to get hired which is what it seems like you would have to do if the company didn't hire you.

i really don't think there is a law against that kind of employment in NY
I worked for Sony Music (in Santa Monica) but half of my workmates were in Sony Music on 5500 Madison in NY. All of us were basically permalancers. We were full time but not quite staff.
-No benefits (like a lot of artists jobs)
-At will (like most jobs)
-They'd let us go if the work isnt heavy enough (like most jobs)
-Not considered "full time" but I was on payroll. The only difference between me and the other freelancers that came in and out of the department was they werent around long enough to have their check handed to them at their desk so it was mailed to their house.

oh yeah.. and they called us Per Diem and we didn't get overtime.

Hey...
I'm in a similiar sh!ty situation too, I was just exposed to this info today that there is a time on freelancers where the company either has to hire you or fire you. That whole full time for over a year with no insurance is illegal. As soon as I find info, I'll pass it on.

yes please do
this is not like shellie's situation or a lot of other peoples
other than her not being hired she is treated extremely well
she gets 6 weeks vacation like everyone else
if she leaves early she still gets paid
she just wants health benefits

I know Microsoft got nailed for how they skirted around hiring employees and exploiting contractors...but I think that was a state mandated situation and in the end it screwed the contractors because to get around hiring contractors as employees, they just dropped them for whatever time lapse was allowed.
