Are all tumblr pics public domain? Does Tumblr own the rights? Has any one approached a tumblr owner and asked to use an image for commercial work?
- _niko0
thanks, still not 100% clear on the legality of it, but more interested in the second part which has to do with getting owner permission.

what exactly do you mean by "tumblr pics"? pics on tumblr are copyrighted to the respected owner like anything so you need their permission to use it.
this has come up before on QBN but most tumblr users post other people's copyrighted images under the premise of "fair use". I have argued it is less than fair use considering so many tumblr posts are devoid of context, commentary or attribution.

A client recently argued that the photos they were asking me to use were fair game because they found them on Google. I had to explain that just because it's on the internet doesn't mean that it's free to use, especially in our campaigns. Tough conversation to have with cheap bastards who have no understanding of creative rights.
- right, well replace google with tumblr why would it be any different?Miguex

hahaha WTF?
Half expected this to be a cirque thread seen as most of his portfolio is shit off Pintrest
If I take a piece of your work and upload it to an IMAGE HOST does it suddenly become fair use?
- *high five!* yep, I use "moodboards" alot! but thanks for bringing me up!cirquemedia
- so do 90% of designers I know, but I have never used an image other than conveying a conceptcirquemedia

Sorry for the confusion, sites like flickr use creative commons, i was wondering if tumblr had anything similar.
http://www.flickr.com/creativeco…
guess not.

most of images people post on tumblr are pirated from elsewhere. they don't own those

I have a client with a very small budget, can't afford to pay for high-end stock photography and istock is cheap(er) but pretty shitty.
I found tons of amazing imagery on Tumblr and was wondering if a) they had something like a creative commons licensing agreement and b) if anyone has ever approached a tumblr user for use of their material and what the costs or experience was like.
as hotroddy pointed out, it's almost impossible finding the original creator of most images on Tumblr as they've been posted and re-posted a hundred times.

a Tumblr is a blog, duder. Copyright is to the respective creator of the image. Finding an image on a tumblr is really no different than finding an image on google image search...
- _niko0
fair enough, thanks for the input, i just need to dig deeper for the image's creator then.
Cheers.

I've used Tumblr pics before.
It's hard to find the content origin because people don't quote the source.
Drag them to desktop, then into google image search, you'll find the photographer / artist easily.
Get in touch with them, and get permission.
If people hijacked my shit from my Tumblr (original content, not reposts) I'd be fucking furious.
Also, your attitude towards "fair game" and not knowing this, is a little aggravating.

^ You can c&p the URL into GIS, you don't need to save the image to your computer first.

thanks for the input, i think my original post was rushed and inarticulate and it does sound a bit sneaky which wasn't my intention.
As far as images being "fair game", I was asking about Tumblr specifically because it functions differently than google image search and flickr.
On Tumblr some people are making money with their sites by doing nothing more than reposting images from other people's tumblrs. In this case, they are profiting by using images that were not created by themselves and doing nothing more that giving credit or linking back to the creator's tumblr (if that).
So my question is, if i did the same thing, used a tumblr image for a commercial site, blog etc and gave credit to the creator and linked the image back to the original tumblr site, would it be essentially the same thing?
It seems to me that if you are profiting or using an image commercially you should pay or ask permission from the creator to use it, but this isn't how tumblr works is it?

On this note I just found out a photo i took posted to flickr was "reblogged" more than 1,000 times on tumbler. So if what you are saying has any truth people are getting paid to post my image without my knowledge? What the fuck?
It seems you can post any image you find on the internet to tumblr, so in a sense finding an image on tumblr is no different than finding an image on google.

hilarious - "Half expected this to be a cirque thread seen as most of his portfolio is shit off Pintrest" (pinterest)... I use moodboards and concept imagery quite a bit, it's called the "creative process" buddy - so does every single design agency and designer I know... It's called research, I'm just one of the first few to openly showcase my thought process and won't be the last. I'm very good at it, self admitted... Carry on.

Pinterest and "private boards" are used by half the designers I know... Here's a secret... Art directors like:

Got me started... He's a genius, and if you think half the work produced out there (anything ever designed) isn't "influenced" or "inspired" by other work, well, quite frankly... You're a moron.
