where the text scrolls over the header image?

css + js (jquery)

The bg image is fixed either on the body or a lower z-index div. The copy is in a higher index div that scrolls over. I assume anyway. If you look at the source you can infer more.

damn as simple as z-index eh might have to give it a try

<div class="nytmm_section" name="to-the-peak" data-label="To the Peak">
<div class="nytmm_article image_cover">
<div class="nytmm_fs_img"><img src="../chapter2_flat.jpg"/></div>
<div class="nytmm_chapter_head light" id="nytmm_head_1">
<div class="nytmm_inner_head">
<span>Part Two</span>
<h2>To the Peak</h2>
</div>
</div>
</div>

Not really z-index all the div.nytmm_article are same z-index, though the first div's child content is position:fixed. So I believe that allows the parent div.nytmm_article to scroll over it.

also uses javascript to position the text layer depending on browser window height
