Isn't it legal to use a source material if you sufficiently change it and make it into something new? Andy Warhol "stole" existing photos of Marylin Monroe and painted them... don't think he ever got sued.

indeed, but read the story, he settled on fair use out of court, it was his cloak and dagger nonsense that has come back to bite his ass

Criminal contempt is a misdemeanor charge that carries a maximum penalty of up to six months in prison
He may spend a day or two in a celebrity cell if he gets any time at all. I'm sure he'll just get some community service.

This guy is really starting to bug me. I was working on a movie last year and created some art in the Russian Constructivist style. I submitted it to legal for clearance and the response I got was that Shepard Fairey was suing the pants off people who were using that style claiming that it was a rip of his work. I can't believe he is trying to claim a movement in design as his own. After lengthy arguments I had to shelve my art because Fox is worried about being sued by him.
