Looking for best practices.
What is the max size you would make it?
Should it be scalable or fixed?

i dunno. i've never seen this discussion brought up before. i think it's something that's just decided on a case-by-case basis. is this a mobile environment? web? is it important that the modal window can be moved so as not to obscure content? seems prettay straight-forward

It is web, I am not a dev so I have no idea. I would think a max height and width would be called for so as not to open the window below the fold. Unless absolutely necessary.

how much content do you need to fit into it?

they all differ.

personally, i'd standardize the size. if you have tons of content in some of them, then just create a div with overflow set to scroll to allow for consistency. of course, i have no context here, so that's just a general rule.
anway, modal just means, 'hey, i need your attention before you can move forward', so it's really up to you how it looks and how much of the screen real estate it takes up. not really any hard-fast rules about it.

Whatever size you make it, be sure to gray out the background or something to bring focus to the window.
