I took a pic of 2 girls at a festival and would love to use them in a design... but just wondering if I'd need a model release for that? It'll be a small element on the website (they faces will be about 30px high), but will be seen by a few hundred people a day for a few months so there's a fair chance they or someone they know will see it.
On one hand I'm sure I'd need a model release.... but then how do images like this get up on Getty? It's not like the photographer can wade in there and ask...

Could be tricky. Do you know the girls at all, could you get a release? Did you have permission to be there taking photos?
If you answer no to the above, then I would say no, you can't use the shot for commercial purposes.

The laws regarding this is different from country to country. As long as they are in a public space and you shot it from the pit, I donĀ“t think there will be any problem using it without a model release. I assume they were aware that the picture was taken?
Tracking them down to ask for usage will probably be extremely time consuming, but then you will be safe. I say go for it.

I can't even submit to iStockphoto without a model release if the individual is recognizable in the shot.
I have been to concerts/comedy shows that have been filmed where buying the ticket and getting in the door was essentially tied to a release form that allowed permission to shoot you. I doubt that's the case for the example above though.

I don't know the girls but they definitely knew they were being snapped... they're smiling at me.
But I'm leaning toward MrNibs' advice... making a slightly better promo is not really worth risking a lawsuit. that being said, though... that's iStock.. they have to be super paranoid as the come across all situations.
Anyone know about the law in the UK specifically?
