If I'm laid off because there isn't enough work. But then I find out later, they are hiring someone else.
For the same position.
Can I take legal action?

Not if you're under an at-will contract.
Best of luck, man.

Sorry to hear that you're out of work.
You'd rather have been fired though? If you're laid off, you can collect EI benefits. Time for some free money!

yea I signed a one month contract... and they were suppose to hire me on after the one month..
but they said there wasn't enough work.. .now I find out they're hiring another person- Time to talk to the Labour Board, son. Is everything - including the reason for dismissal - on paper?Continuity

Yeah, sounds like they just didn't think you were a good fit, but were too chickenshit to say so. If you were on a one month contract you're pretty much screwed. In fact, typically at any new job you're placed on three months probation (which can be extended) where they can fire you for any damn reason they please.

crap. brush off the dirty and move on. get a better job.
- Claymantis0
yea total bullshit man

@Claymantis,
It's pretty common practice. They got you for cheap for one month and now they don't feel like paying you a salary so onto the next one-month lackey.
- yea I just wish they were honestClaymantis
- Probably their intentions were good, they tried to pad it for you "it's not you, it's us"raf
- "it's not you, it's us"

They don't want you, but who they hire in your place is not your business anymore.
Don't waste your energy on them, that's not worth it, move on.

Look into your state's laws. In most states employers can fire or hire their employees at a moments notice for any reason at all.
