A bit of time and effort and I managed to find the photographer - sent him a long, explanatory email about the image and he emailed back with 'no problem, go ahead.' Worth the effort to track him down. Here's his site (which doesn't have the original photograph)

Should be fine. It's still something you created with your own hand (or the severed hand of a dead hooker. How the hell should I know, you goddamn lunatic. Hooker killer!!), and not repurposing the photo itself.

it could be copyright infringement. If someone could look at that drawing and instantly know that it came from their photo you might have a problem.

its a fine line. Try and alter the composition a little in photoshop and make sure its substantially different from the photo.
Maybe reflect it so the car is on the other side, and add a couple inches of black to the top, for example.

did you actually sit down with the intent to copy that photo, or was this merely an inspired angle? in all honesty i'd wager that you'd have no issues whatsoever, unless you literally traced the image, but even then it would be a hard-sell imo

Why not draw a tree into the background? Then you've changed it enough that it's not a violation?
