Your problem isn't so much that you're ripping someone off, it's that the mark is too generic. Ever heard of the whole Quark debacle a few years ago? They got sued by the Scottish Arts Council for ripping off their logo. The trouble is, both logos were very generic in form.

Actually that shape has been used a trillion times, theirs nothing quite unique about it I also wouldn't worry about it being overtly looking like someone else's work because their all quite similar. its a pinwheel and pinwheel logos are everywhere.
