I did not get a H1B US visa last april and I'm about to miss the job ; the place has to be filled.By any chance, would you know any other kind of visa which would allow me to move and work there, even on a 1 or 2 year basis?

my family and i moved here on an E visa, which is an investor's visa. i don't know if that helps :\

This visa is somewhat unusual as it allows the holder to work in the US, yet does not require the filing and approval of a petition to the US Citizenship and Immigration Services like most work visas do. But does freelancing allows me to ask for a such visa? can freelancing be considered as a "foreign company"?

You have three options.
1. Try for O-1 visa, this still takes about 3-6 months
This only really applies if you have won lots of awards etc.

Costly but this allows you to work at least part time or freelance.3. Semi-legal status
You can come to US under travel visa and try your luck in getting a visa. Depending on a company you can work freelance with out proper work paper. This can be costly and if the HLS finds out you will not be allowed back in.

The other longer term option is to get L-1 visa. This is a transfer visa. You must work for a company in France for at least a year which has relationship with a company in US. Many advertising companies are like such. Ex, WPP, Interpublic, Publicis, etc
This takes a long time but the advantage of this is that after you finish your min 1 year stay in France, you can apply for a same holding company in US. It does not need to be same company but as long as they are with in holding company.
Ex, for WPP, any of the listed company
http://www.wpp.com/wpp/companies…The main advantage of L-1 is the ability to obtain greencard after you get a job in US and has been employed with them for 1 year. The process for greencard under L-1 takes about 6-12 months, which is un-heard of (normal process can take up to 10 years with average of 5-6 years).
The road map would be such:
1. X company with XX holding company in France
2. Stay for one year in France with that company
3. Apply for job with one of the XX holding company
4. Work for Y company in XX holding company in US with L-1 visa
5. After one year with Y company, apply for greencardOne down side is that most of the holding companies have rules against moving with in the network. I would prefer to choose another company with in the network. Unless you are approved, it is hard to transfer over with in company due to the none pouching rule. The main caveat is that the originating company has the final say. If you are not in good terms with them they can terminate your employment in France because you even make a move to US or apply.

2.could be a solution, I have to check if the applying period is ok (but I doubt I can manage to have it ready within a month)

Don't want to put myself nor my employer in a bas situation, and being banned is too bad (I rather miss this time and being able to apply next years)F**K, this is so frustrating ; I have a job I'd love to have waiting for me, twice better paid than any I had before and interesting, and I'm currently unemployed in france since nearly 1year.....

The other option is to apply for job in Canada and after about 1 year, make the move to US. It tends to be easier coming from Canada to US then from other country to US.

I would consult a immigration lawyer to find a path. They can reapply your rejected application. It can be costly but well worth it in the end.

I have used these guys, they have office in France also. Very good. The process with them has lead me to greencard in 3 months. And visa with in few weeks.

My main concern is that I wanted this particular job position. the job could have been anywhere else, I would have been ok to move.

Seriously, do some research, contact an immigration attorney. i am sure there is a way or a loophole...
Oh, and good luck with INS, pray that the person in chrge of your petition is having a good day or that he/she didn't fight with her/his spouse that day, because they can and will fuck up your case and life in 5 minutes...

This is where my genius idea about a visa swap would come in handy.
The world's governments need to implement some sort of program where - for example - if I live in the US and want to live/work in France, and dyspl is in France and wants to live/work in the US and we have comparable earning potential, we both do some paperwork and just switch... no one really gains and no one really loses taxable income and personal spending remain the same.
