thanks everyone. I appreciate the feedback.
Basically, if I think I have a snowballs chance in hell to recoup the rest of the cash, hold off on depositing the check. I do have an attorney that handles small things for me, so, he might be another step. I'm trying to play nice just incase this can be resolved.

This makes me angry! I had a client/friend that rushed an order of business cards through me. I fronted the money for the printing and they provided a check on delivery...the check bounced.
I fought them for 3 months. Then sent a "request payment" through PayPal.
They magically paid it that day. weird.Get a contract on EVERYTHING from now on.

DON'T BANK IT! - if you bank it means you accept that that is full and final payment.
But keep the cheque. Yank the site (you still have FTP?) . When he asked what's going on, say on full payment it will be reinstated. If nothing happens (he doesn;t call after a while) bank the cheque and cut your losses.
A funny story: We designed a site for a company that didn;t pay their bills for 11 months!! - after about 1000 phone calls and excuses I got so sick of it I yanked their weebsite (pretty big company) and put a message up saying "WEBSITE UNAVAILABLE DUE TO EXTREMELY OVERDUE ACCOUNT" - with in two hours a cheque was couriered to me.

This was calculated on their part. They have since changed the FTP log in credentials. The partner in the company has since "blocked me" on IM. He won't answer the phone. Looking into legal actions as we speak.

if theyve changed the ftp details and blocked you then they obv know they are screwing you over.

Next time use a real estimate, have your clients agree to it online & sign you a copy. 1/2 up front is what I usually charge.

Oh, I hear you. I should have known better. The sad part about all this, is that the guy is in the creative industry. He's been running a 2-person shop for years, and should know not to fuck people over. Its just bad business, bad karma and will eventually bite you in the ass.

I would send an e-mail stating your position and, if they don't respond, threaten to take action either by contacting a lawyer and/or spreading the word on their behavior. If you have mutual contacts in the industry, that could be used to gain leverage. Hard to know what would lead a company to stiff you like that but often the threat of any kind of headache will be enough to get them to pay up.
Remember, you are the one acting professional here, so you at least have the moral high ground. Good luck.

Ok, same thing happened to me in NYC with my first freelance gig. Except, I gave them nothing, not even samples. They gave me 50 bucks deposit, loved the design, and ran off never to be heard from again after many excuses for not paying. I ate the project and learned from it. NEVER AGAIN. You however, have a check... So as long as you don't cash it, you have a decent chance of getting the rest of the money. Talk to your lawyer ASAP. If you were Puerto Rican you could get your cousins to knife them, too bad for you... Good luck!

due to the copyright laws, the art belongs to the artist. so, unless they payed in full and contract has be sign. un till that, they need to take the site down.

burn all the files on a cd or dvd, post it to your self, do not opend. thats what musician/artist does when they need a cheap way to protect thier work.
the imported thing is the date that is stamped.
i know you got emails etc. which are good support. also.
