What's the general consensus on asking clients to sign and agree to your terms of trading prior to starting a job? do they need to be totally legally binding?

email is legally binding so just make sure you get it all in an email.

I always use a modified GAG work order form. It protects both parties. I only work with one guy that I trust without a black and white.

There should be some kind of statement of work and payment for completion. I think a formal or semi-formal agreement signed by both parties is better than an email string.

email for clients that we've been doing work for for years, but a clear confirmation on scope and costs
legally binding is probably a relative term. I got screwed by one of my early clients with a "I'll sign it if you want, but you realize if I don't want to pay I won't." And, like a fool, I still did the project and lost 15k.
contracts are great, but you it is not an end all. Good relationships and working with people you trust are what matters most.
