no i have 'snap to grid' and 'snap to point' on
the guides are simple points which are inside the grid cells, so it should snap either to grid or to guides
rectangle tool snaps to both when guides are locked
pen tool only to grid -- to guides only when unlocked

I just checked to be sure in IA 9.0.2 (pulled out my old powerbook) and CS2, which I am used to, it snaps with guides locked. Too serious to be a bug if still unfixed, i think
Funny thing btw, just spent 4 hours straight in Mac OS 9, stood up and went to kitchen, everything felt so 2001, like i was in the past or something....
