has anyone heard of The Orphan Works Act?
Basically what this bill does, is allow ANYONE to use YOUR artwork if it isn't copyrighted.
The Orphan Works Act will affect all images from professional paintings to family snapshots. This includes any image, whether published or unpublished - or any that resides or ever resided on the internet. It will force us to register every image we make with privately-held commercial registries. All unregistered works will be exposed as potential orphans for commercial infringement.
Unfortunately, theres a big hole in the plan: even if you have your work copyrighted, they can still use it. If you take them to court on copyright infringement, the can say there was no visual proof of copyright on the image when they found it and they will be protected under this bill. and we all know how easy it is to rubber stamp out a copyright.This is too important to ignore please participate and forward to your others.

I'm starting to realize more and more that in order to reach the top, you can't let shit like cheap copies and thieves get to you. You just have to be the one to set the playing field so that you're always one step ahead, and eventually you'll get noticed for being the innovative one. Granted, this is easy for me to say (harder to swallow) and really only applies to relatively high profile work, so I'd still be pissed off if this bill passed. So, go get 'em people! (being a "minor", I serve no purpose to my government for the time being)

if you have a blog with your sketches, design tests, whatever, they can be used commerciallythe only way to protect yourself here is to put a huge ugly copyright across the middle of your work making it look like shit

how exactly is this any different than the already grey, amorphous copyright laws for the internet as they stand now?
getting around "copyright"s on the internet is painfully easy. in fact, any image any of us has ever posted online has HAD the potential to be stolen as soon as it was posted.

So... how will this work where works of a foreign origination are used in an American product in this context? Effectively, this gives Americans carte blanche to rip off the rest of the world's creative output on their home turf? Surely this can't be anywhere near legitimate - or am I missing something?

Knowing how freakish clients and agencies are (usually) about potential for litigation, I'm not really buying this doomsday scenario.
Having read those links, the bill talks about placing limits on judicial remedy. That does not mean open season on everyone's Flickr pool or their precious artwork is going to appear in Marlboro ads.
