I want to create a paragraph style where a colored line appears behind all the text but it seems that they have changed this in CS3 so that the "rule above/below" actually only does the first or last line of the paragraph. anyone know a workaround? It worked in CS2 I'm pretty sure.

Pretty sure this will work with hard returns, which will only work on short paras of text. Not sure how to do this another way :(

what's the solution then?

I think the rule above/below is only for the Paragraph styles. Maybe try using a Character style with the underline option for the body copy? You can style the underline in the character styles. Hope it works/helps.
