hey, I agree "a hard life" is relative. And a website is after all just a website.
Nevertheless it's tough when you're running a business and competing with all kinds of other shite to make things work.
I don't consider myself to be in peril, so no, things aren't as hard as they are for some. BUT, I don't need this, and quite frankly, I've had my fair share of bad crap happen in my life to make this "minor thing" just add toward the conclusion that things ain't as easy as I was lead to believe when I was twenty.

You're intellectual rights were violated go violate the fucker...I mean sue the bastard. Pursue legal action even if you don't get a compensation he/she might learn a lesson.

To be honest, if you met the client you'd want to violate him too. He's a c**t. His, staff hate him, (he has a high turnover of staff). Other local businesses hate him. . . I was willing to give him the benefit of the doubt, although I had heard bad things about him. I figured maybe it was sour grapes. Seems like I was wrong and they were right.
I don't get why people behave like that. He's effectively shafting other local businesses (us) and our client from whom he stole the design.
How can he think, "yeah, that's fine, I'll do that"?

if you have any contract or emails that you can prove that you have done the design first and gave that to the client, than i would sue them

nah.do what mrD said, if youve got emails where you sent them the visuals then use that to build up a case and hopefully persue them.
even if you just get your design time paid for thatd be nice of themyou get clients like that in general who go round design companies, get some stuff done then fall out with them and move onto another company, get some more work done ... and in the end they end up having all their stuff designed/completed to a certain degree all by good companies then they take these designs (or even just the knowledge theyve learned from each respective company) and get someone sh*te to build the final things they need.

Yup, get your written proof, and then consult lawyer. Perhaps a cease & desist letter, until payment is made. This may take a while for it all to play out though. Good luck.

have they not ripped an existing website you have designed? if so, you don't really need proof of corespondance, just get your lawyer onto them to take it down.

All good advice. We'll need to consult here. Basically, they ripped a design we did for an existing client - which we showed them and they liked.
We have informed the existing client who is not best pleased.
Trouble is you end up just wanting to move on, but not being able to because you so want to make them suffer in some way.
