i just created a design that uses the a photograph of a famous model. i traced around her and removed her surroundings and the removed her face. so, all that is left is the hair and body. i then create an illustrative backrgound and put type over it. now, my question is whether i can publish this illustration (was thinking of submitting it to the semi-permanant book) or would the use of the image be a problem?
im not quite sure where the line is drawn and it becomes a piece of my work (ala warhol and rauschenberg).

i'm no ip attorney, but i think it's fine. as long as the final piece is no longer immediately recognizable as the image you used.

No, that's a derivative work and a copyright violation. A photographer could sue you for moral rights violation. But it also depends how it's used. Gallery context-probably fair use. Commercial, probably not.

This isn't rocket science, just make it different enough that it isn't identical to the original. There's no law against using another work as a reference.
