My studio name just got jacked, and I got it earlier than they did.
Now they got an LLC license. Damn, I feel like I got torn a new one.

There are different forms of business registration. Company and business name. You can register a business name, and not an actual business.
There are registration forms that cover the whole US or Canada or worldwide for names and business types.
Im pretty sure that even though they have a Limited Liability, you can get an Incorporated or Corporation. You would just pay a bit more to do this, but you would be covered throughout all states.
Or else just register your LLC as something like "Funktion Studios Worldwide". You can keep the public name as ust plain "Funktion Studios."
Good luck with that dood! And drop by your local government office to do the whole process properly.

Theirs was registered in 2004. I barely know the legalities involved, and I'm mostly freelancing so it's not a big deal, but still.....
I added the hyphen so it wouldn't seem so confusing.

yes they can F him over. He just owns a domain name. Not a business. They have a registered business. They can prevent him from doing business under that name. However, since he had the domain before they registered their business, he would still be able to keep it.
I highly suggest you add something like "worldwide" to the end of your name and register it asap.

Man, that's kinda heartbreaking. I had dreams of building up my studio in 5 years time. I should've been smarter, but I was a junior in high school, and I never worried about that stuff.

from what i understand working for a dba firm and freelancing myself he can continue to use his domain and name. it has to do with what is actually registered with the STATE and as i see one is in NJ and one is in NY he should hop to in NY to get his name registered all problems can most likely be avoided the easiest way would be to do his name "Tommy Wooh" dba [doing business as] Funktion Studioscall a bank and tell them you want to open an account under "funktion studios" they will inform you where to go to get your paperwork be it from city hall or whatever.30 bucks later you'll be cashing checks made out to funktion studios

being austrian it always seems a bit strange to me if non german speaking people use german spelling for their site/studio thing.

I think the name Funktion inside design it's beign used in many places around the world, its not like its something people can't come out with hardly.
There are probably other studios aorund the world with that name. what is sepparates you both is the quality of work, people will only remember the best.
I can see it being a problem whit the web address, you have the - i think I would type with no dash first If I ever forget the address.
And about the fullscreen, you have the option, go full screen and regular whay would you change that?
It's your site and you are giving the option to the user, you did the right thing I say do what YOU think it's best!

you should contact him.. let him know of your situation.. and see if he'd like to be a team.. (considering he's by himself under the company name) and you could be the NY office or something..
