i have friends that have, they got lawyers and one got off, 2 got fined pretty hard. you should check with a lawyer

I'd follow BonSeff's advice.
a friend of mine did that the first time he got a DUI. the second time he got one, he quit drinking. He figured that if he was stupid enough to do it twice, he shouldn't drink at all. Put the money he would have blown at the bars in a savings account each weekend. Bought himself a Spider on his 2 year sober anniversary.

the one that got off paid almost 4 large. and he had the wobbly boot on video, he passed out at a stoplight with a cop behind him!
not sure about the other two.

I am prepared to pay the fines, and probably looking at $4000 with legal fees (what a waste...) but I am mainly concerned about loosing my driving priviliges.

driving drunk and 'driving under the influence' are quite different things. i can bet that alot of ppl in here have driven when they probably knew that they were close to that line. most people can drive fine and be over the legal limit, people that drive when they're plastered are completely stupid, but it's hard to know, it's obviously always best to never get behind the wheel either way.

the word 'drunk' is completely subjective.
it all depends on body weight/tolerance, etc.
regardless, ppl that do it regularly are complete morons and should have their licenses revoked.

take my advice. pay a lawyer whatever it takes to drop the DUI charge. get a WET RECKLESS and you won't have a DUI on your record. it will cost a bunch for legal fees (probably around 5K), but you won't regret it later. if you have a DUI, you're looking at close to $5K/year for full coverage auto insurance after you get your license back. you will also need to get an SR22 form to keep a CA drivers license for at least 3 years.

get a good lawyer. you'll be spending about 5 grand for first offense plus lawyer fees. I've never been caught but a friend of mine has... just don't ever get caught a second time cuz that's some serious money and labor... unless you are a rich kid that is.
