Let's say I buy a old pair of jeans in a thrift shop. If i was to take off the label, make some modifications to the jeans, and slap on my own label and sell it is this allowed? or infringement?

well that never stopped half the stalls at portobello market...
- wendell0
you may be good at asking pascii on it when he made the cock hat jean. of me
- ILuvSushi0
yeah. Im interested in learning the answer to this. im thinking if i change it enough its no longer owned by a certain label ex: levi's.
so i would think i could slap on my own label.
- thosethat0
seriously though...
i've seen people down portobello selling all kinda army chemical warfare trousers... straight from the army surplus store... with their own label just sewn on... they didn't even change them in any way...
- JamesEngage0
Well if you've bought them in the first place they are yours anyway aren't they? they've made their money.
- stewart0
hey JamesEngage, if our clients think like you do, we're doomed.
- JamesEngage0
whys that?
- JamesEngage0
it's just customization isn't it? like brabus do for smart car for a hi-tech example... they probably have permission though? but then it's partly because they're selling through smart. and there is a safety issue....
Levis probably encourage creativity

I dont think the people at levi's or lee will give a care, they made their cost and a considerable markup of the product once.
you dont see VW freaking out when people remove the logos and paint their beetles with black splotches and a big cooper font "cowmobile" down the side, do ya.
I say go for it.

i should give it a try. Damn, now I gotta find someone that can sew :(
and i need name/brand for a prototype.

You know levis are trying to take down http://www.howies.co.uk because they put a label in the same place on the back pocket and it wasn't even the same colour or size. So I bet they would give a shit.

Are you talking about the trampy portobello market in edinburgh?
- thosethat0
no...
london...
- Jnr_Madison0
Ahhhhh.
- thosethat0
although trampy does still apply to a certain extent..!

It is totally OK to do it. You're not knocking off someone else's garment. It remains theirs, and you do your modifications on top of the original.
It's no different than thrifting (or buying) a Fruit-of-the-Loom tee shirt, screenprinting it, and selling it with your own label. You are using the thrifted garments as a base for your customized product.
Tons of boutique designers all over the planet do it. Even Levi's has a store in NoLIta where they produce limited edition custom versions of their own vintage products.
People are customizing Nike and Adidas all over the place, too!
Sometimes the big labels encourage it.
Just be sure to market them as "customized Levi's®" with your own label stitched on. The only reason the big brands would get pissed off would be if you acted like the garment was your own end-to-end design. Or if it was a counterfeit garment that you tried top pass off as the real thing.
Have fun!
