I was always under the impression that these media companies were more interested in catching the big fish, the ones who are the source suppliers of all sorts of things like software, movies, music, etc ... you know, the major crackerz/ripperz, not necessarily the sole individual downloading a Metallica album.
Apparently not.
That said, I suppose the media companies would pursue the maximum penalty allowable by law wherever it is they're pressing charges. Whether it's a summary or indictable (fine or imprisonment, respectively) offence is up to whatever jurisdiction in which you live.
