  I think it varies state-to-state. That being said i think most states would issue citations at the scene of the accident and not after-the-fact.

  You need to get a copy of the accident report from the officer or police dept as well.

  Also, you should have contacted your insurance company IMMEDIATELY. They are your worst enemy in most cases and the more evidence you have to back up your claim the better off you will be. You don't want to call them after the fact because they might try to weasel you out of service.
