    I think Fairey already knows he's lost this case. His lawyers are constantly keen to stress that he didn't profit from the huge amount of merch sales he made. In a black and white legal analysis, what Fairey chose to do with the money that his merch made is completely irrelevant, he sold the goods and received payment. Any charitable use of that money is mere plea bargaining material after the conviction has been secured. As far as the prosecution is concerned he sold that image on merch and the revenue was immense. Fairey's people know it and that's what they are wasting their time hammering home that he didn't personally profit from it.

    He re-funnelled a lot of the profit back into making more merch. That doesn't get him off the hook, that merely proves he was investing in his business and its stock of goods.

    I really do think he'll be fucked.
