From what I understand the judge reviewed case law and figured out that he made a mistake in not giving them the choice in the first place. Both sides are supposed to argue for and against giving the jury that instruction tomorrow.
I seriously don't understand how our legal system can be this fucked. Actually, it's the people in LA. This guy couldn't be more guilty and they're locked up at 5 against 7?!?! What the how?!? Girl goes back to his house, a guy she's never met before, finds his gun and blows her face off? How does that make any sense? He goes out and tells his limo driver that 'I think I just killed someone!' But 5 or 7 people think he's innocent?? wow.
