Printers and overrun costs

Has anyone come across this before and what was their experience/outcome?
here's the short story:
We ordered 5000 labels from a printerThey invoiced us for 5000 upon taking the order – we paid 50% upon booking
They delivered 5,500 and invoiced us the extra AFTER delivery was made (and after we’d invoiced our client)
We paid the remainder 50% of the original order
Now they are pursuing the extra cost of £162 for the over-run which they say is within their (up to 10% overrun charges) terms/conditions
Now they are threatening legal action as they say they're within their rights to charge up to 10% for overruns.
I've worked for 11 years in this industry, purchasing print runs over 100k units and never heard of anything this ridiculous before. I personally think it's a piss-take and very unprofessional.
Why should we pay for their failure to print the amount we ordered and their failure to communicate this prior to delivery?
I'd be interested to hear if anyone else has experience this?

Never heard of anything like that.
Send the 450 back. Pay for the other 50.

yeah, send the overs back, thats ridiculous.
I have heard of it before but its pretty archaic. In todays business world it would mean they don't care about your business and are sticking it to you.
Seems like a phone call telling them you and everyone you know will never print with them again unless they fix it for you.

send them back for sure. usually they warehouse them in case you want to order more, but never should they charge you for the overs.
i say they are trying to screw you over.

It seems like they purposely trying to shaft us - I've already told them that I'll be sharing my experience with the community and colleagues but they're still sticking to their T&C's.
It's not that easy to send back the overs - they're actually custom-made vouchers so could potentially be mis-used if sent back. We'd have to destroy them or void them first.

if its a one of a kind item that could have a value of some sort, like a voucher then it kind of makes sense to me. Sounds like maybe a goof not adding in that cost to your client.
I see your side of it too. Maybe the client will want them...

yes - agreed a price, confirmed order.
Order was delivered 10% qty over so therefore 10% extra charge?! WTF?

I've seen this before for some self loading gift cards I did as well as come custom domed decals. However in both instances it was outlined in the estimate.

was it in the estimate or given to you in some sort of verifiable way? If they just sprung it on you do not pay. They may say its their policy but if its not in a contract, agreement or legalese of some sort its BS.

Are the overs really make readys?

What capn_ron said. It's common to bill for overs, but they seem to have taken advantage of that by running right up to what's allowable. It makes me wonder if this is their standard way of doing business and getting more profit out of clients. Btw, does their quote mention how they handle overs?

that really is tough. my roofer went above the estimate by about $700 due to needing to replace a few panels under the shingles that he wasnt able to see from the initial quote- but he was more than willing to eat up a bit of that cost himself to keep me happy - when i need to re-roof in 30-35 years he'll be the first person i contact. i pray he's still alive. fact is, there are often unforeseen cost on jobs, hence the word "estimate" - but this printer just sounds ridiculous and the extra prints were probably avoidable.
- Roofers... I know a roofer, the poor guy constantly discovers rotton wood under the roofs, not easy to deal with on estimate...vaxorcist

^ different situation though, it's not like your roofer went and added a 3 foot overhang around your house and then charged you for that. In the end you got what you asked for, and it just happened to cost more.

What was the exact wording for the overrun terms & conditions? I'm curious, because this whole thing is shady. A printer will often run hundreds and hundreds of sheets just to get a machine warmed up, which will be thrown away. They don't charge for those, so why would they charge for 500...exactly? I mean, it's not like they only printed 500 more.
Imagine walking into a doughnut shop and ordering a dozen donuts for $10, but being charged $15 because the guy behind the counter felt like throwing in 15 donuts. It's just not right.
