Indesign CS4 problem

here is the situation:
We have a page in indesign,
we have 2circels overlapping eachother, and the top of the page we can use the pathfinder,
at the bottom we cant, indesign gives an error wich says it can't do the pathfinder because it is an empty area.. ?!
same cirkels as at the top of page where it worked. and nothing has changed.. we just moved the circles down.

Same problem on 3 computers now..
it's a file:
70 pages
5mm bleed
pages next to eachother..try it on page 1, WORKS
that try on page 35 or so.. DOESNT WORK

i send you nothing, make yur own blank file

now do a pathfinder thing on page 1
and then again on page 35
the thing doesn't work from page 12 -> 70

It's a bug.
The only solutions are:
1) Work with pathfinder in Illustrator and copy-paste your vectors.
2) In InDesign group your objects, scale them and use pathfinder, than resize them to the original size.
