old question about music on website

i dont know if there are new laws for this type of legal issues regarding music being used on a website, but a friend of mine told me that it is now somewhat ok or legal to use any music/song as background music to a website as long as the website isnt a commercial website or a site that would entice audience to generate an income using the site itself.
are there any truth to this? or is it still illegal to use a music/song as background music in a personal / portfolio website?
hoping to hear everyones thoughts on this...thanks!

I have been using BG music on my sounds for about 7 years now.
no FBI knocking on my door in these years.

just post a link on your site: music by.....and a link to amazon where you can purchase the track.... your golden.

from what i heard and read before, i think they will contact you first to ask you to take out the music on your site before they take legal action. but like i said, that was before. its good to hear though that nobody was filed or convicted for this kind of issues.

wow!?!?...but from what I understand, I think majority of these record labels/companies file legal actions if their music has been used in a commercial site or a site that generates income directly from the visitors...but then again, this was before.
anyway, just sharing my thoughts again on this issue. hope someone in the legal business could give us a clear answer to this.

I have a little experience in this stuff. I don't think it is legal to use copyrighted music without the permission of the publisher or paying royalties to the publisher.
That being said, if you are any smaller than Amazon.com I highly doubt BMI or ASCAP is going to find out.
Please keep in mind that no one wants to hear music on a site unless the site is myspace, a band's website or a streaming service like Pandora.

I think the basic answer is it is not legal, but if it is used non-commercially and you don't have a ton of folks looking at your site, then you probably won't get caught.
A similar situation happened with usage of getty photos on portfolios a while back, right? A few designers had non-rights-purchased images in comps on their portfolios and got served a cease and desist. I am not sure what ever came of it (or if there was any argument for damages), but it does seem a parallel case, unfortunately.
